Motorbike Accidents: Your right to make a claim

If you have been injured in a motorbike collision which was the fault of another, it may be possible to bring a claim for compensation.

Spring brings with it longer days, hopefully better weather, and a rise in the number of motorbikes on our roads as those bikers who ride for pleasure seize the moment to enjoy this pastime.

Motorcyclists are among the most vulnerable of road users, with statistics published by the Government showing that in 2022, 123 motorcyclists were killed on UK roads, and 1,980 seriously injured.  92% of motorcycle casualties are male, and 66% of motorcycle fatalities occur on rural roads.

Motorbike collision circumstances

The most common contributing factor to road traffic collisions involving motorbikes is a driver or rider failing to look properly, with driver or rider failing to judge the other person’s speed or path, careless/reckless driving and speeding also being in the top five contributing factors.  One third of collisions occur at a T, Y, or staggered junction, and a further one third not within twenty metres of any kind of junction.

Injuries sustained

As motorcyclists have no protection around them in the event of a collision, as a car or van driver would, multiple injuries are often sustained which could lead to many months of rehabilitation.  Fractures, soft tissue injuries and head injuries are common, along with spinal injuries and amputation of a limb.

Benefits of bringing a claim following a motorbike collision

If you have been injured in a motorbike collision which was the fault of another, it may be possible to bring a claim for compensation.  Whilst many people may hold the view that a claim for compensation is just about money to compensate for your pain and injuries, in fact it is about much more.

Compensation is split into two categories:

  • Pain, suffering and loss of amenity; and
  • Special damages

What are special damages?

As part of a claim for compensation following a motorbike accident, a specialist serious injury solicitor will be able to arrange private rehabilitation for you to assist you to return to full health or optimise your recovery.

Dependent on the nature of the injuries sustained, your current home may not be suitable, so as part of your claim, a specialist lawyer may instruct an accommodation expert to review what adaptations may be necessary, or whether an entirely new property would be preferable, and your solicitor will include the costings for these changes within your claim.

If your injuries are serious, it is likely you will need a period of time off work, or you may need to change your job post-injury, taking lower paid employment.  Your specialist solicitor will consider this and ensure that this is included within your claim.

For some people, ongoing support and care may be needed to assist with day-to-day living, which can also be included within your claim.

Who should I instruct?

It is important to ensure that you instruct a solicitor who is experienced in dealing with serious, life changing injuries, to ensure that you are correctly compensated for your injuries, and any future losses you may incur.  Members of Major Trauma Group are specialists in assisting those injured in motorbike collisions and may be able to act for you under a no-win no-fee agreement.

The process

It is never too early to instruct a solicitor following injury, in fact the earlier you instruct one, the better as evidence can be collected and recollections of the circumstances of the collision are fresh in people’s minds.  They can also start the process to obtain rehabilitation for you as early as possible and potentially obtain an interim payment to assist with any financial difficulties you may be facing as a result of your injuries.

By simply calling or emailing Major Trauma Group, we can put you in touch with one of our specialist motorbike injury lawyers, who will arrange to call you, or meet with you, at a convenient time.  At this first appointment they will collect information on the circumstances of the collision and your injuries, as well as discussing different funding options including no-win no-fee agreements.
